An appeals court Tuesday upheld a lower-court ruling that struck down a Bloomberg administration regulation forbidding businesses regulated by the Department of Health from selling sugary beverages bigger than 16 ounces. The court ruled that the city had exceeded its authority and acted unconstitutionally. Beverage makers and other opponents of the rule cheered the decision.
